Guidelines for Exclusion Measures Against Organized Crime Groups in Inagi City Contracts
In Inagi City, in order to eliminate organized crime groups from all contracts ordered by the city, a new "Guidelines for Exclusion of Organized Crime Groups in Inagi City Contracts" was established and has been in effect since September 10, 2010.
The guidelines state that: (1) the city will not enter into contracts with business operators that have ties to organized crime groups; (2) if it is discovered that the contractor or subcontractor has ties to organized crime groups after the contract is signed, the contract will be terminated; (3) contractors and subcontractors are required to report to the police and to Inagi City if they receive unjust demands from organized crime groups. -- among other policies.
Additionally, business operators that fall under any of the following categories will not be allowed to participate in bids for at least 12 months.
- Business operators who are members of organized crime groups or who are substantially involved in management by members of organized crime groups
- Business operators who unjustly provide money, goods, etc. to gang members, cooperate with or are involved in the maintenance or operation of organized crime groups.
- Business operators recognized as using the power of organized crime groups or their members, with the intent to gain illicit profits or cause damage.
- Business Operators who have relationships that are socially criticized as being with organized crime groups or members of such groups
- Business Operators who entered into a contract knowing that the other party falls under any of the above
- Business Operators who received a recommendation regarding their relationship with organized crime groups, yet engaged in acts equivalent to a recommendation again within one year
Agreement on Exclusion of Organized Crime Groups in Inagi City Contracts
In Inagi City, following the establishment of the guidelines, an agreement was signed with the Organized Crime Control Division of the Tokyo Metropolitan Police Department on April 22, 2011, to build a system for information collaboration with the police.
Information provision, opinion hearing, and submission will be conducted with the Tokyo Metropolitan Police regarding whether the business operators participating in the bid or those already under contract are related to organized crime.
Special Provisions Regarding the Exclusion of Organized Crime Groups in Inagi City Contracts
From the contract dated May 17, 2011, a special provision regarding the exclusion of organized crime groups will be attached to the contract terms.
The provision states that if the contractor is recognized to have a relationship with organized crime groups or their members, the contract can be terminated.
