Procedures under Article 76 of the Land Readjustment Act

The following construction activities within the area of the Land Readjustment Project conducted by the association require the mayor's permission in accordance with Article 76, Paragraph 1 of the Land Readjustment Act.

  • Change of Land Characteristics (Cutting and Filling)
  • New construction, expansion, and renovation of buildings and structures (fences, retaining walls, garages, etc.)
  • Installation or accumulation of items that are not easy to move (over 5 tons)

In addition, an Opinion Statement from each association will be required for the application.

Points to Note

For the "Land Number of the Act" on the Article 76 Application Form, please check with each union office when obtaining the "Provisional Land Certificate" or "Reserved Land Certificate" issued by the union.
If the notation of the "Land Number of the Act" is not uniform, it may affect the building confirmation process.

Starting from April 1, 2022, it will be necessary to present identification documents of the applicant at the time of application and receipt. In the case of corporations, in addition to identification documents, it will be necessary to present documents that indicate affiliation (such as employee ID cards, business cards, etc.).
In conjunction with this, it will no longer be necessary to affix a seal in the applicant and representative sections of the Article 76 application form.

Flow of Permission Application

For the "land number of the act" on the Article 76 permit application form, please confirm at each union office when obtaining the "provisional land certificate" or "reserved land certificate" issued by the union.

If the notation of the "land number of the act" is not unified, it may affect the building confirmation process.

Buildings Requiring Construction Confirmation

For documents 6 to 12, the basic principle is to use the documents for building confirmation application.
Opinion Inquiry to Each Association requires documents 2, 3, and 5 to 12, while Article 76 Permission Application requires documents 1 and 3 to 12 to be attached.

  3. Power of Attorney (specifying the contents related to the procedures of the Land Readjustment Project, Article 76 of the Land Readjustment Act)
  4. Opinion Statement of the Implementer
  5. Copy of provisional land exchange certificate or reserved land certificate, or both
  6. Building Confirmation Application Form (From the Second Page to the Fifth Page)
  7. Guide Map
  8. Site Plan [Scale 1:500 or larger]
  9. Floor plan of each floor [Scale 1:200 or larger]
  10. Elevation drawing (two or more sides) [scale 1:200 or larger]
  11. Cross-sectional view (two or more sides) [scale 1:200 or larger]
  12. Documents showing the basis for the area of the site and buildings

Structures Requiring Building Confirmation

Inquiry of Opinions to Each Association requires the documents from 2, 3, and 5 to 9, and the Article 76 Application Form requires the documents from 1 and 3 to 9 to be attached.

Note: This document will clarify the relocation or new installation of pipe diameter, pipe material, soil cover, position, etc. The same applies to structures, retaining walls, etc.

Activities that do not require permission

Among the construction activities that do not require building confirmation, the following actions that are recognized as not likely to hinder the implementation of the business will have their procedures omitted. Additionally, the relocation of structures carried out at the request of the business operators is not subject to this procedure.
Furthermore, for actions other than those listed below, decisions will be made based on their content, so please consult with the business operators (each association) in advance.

  1. Repairs and renovations that do not require building confirmation for buildings and designated structures
  2. Installation of gas, electricity, telephone, water, and sewerage service lines associated with construction work
  3. Actions agreed upon with the future road manager specified in the business plan for road structures within the road
  4. In cases where procedures equivalent to Article 76 of the Land Readjustment Act are carried out, such as entering into implementation agreements for urban planning projects other than the relevant project (limited to cases not involving building confirmation)
