Procedures under Article 76 of the Land Readjustment Act

Permission from the mayor is required for the following construction activities in the land readjustment project enforcement area of the association enforcement, according to the provisions of Article 76, Paragraph 1 of the Land Readjustment Act.

  • Change of land characteristics (cutting/filling)
  • New construction, extension, and reconstruction of buildings and structures (fences, retaining walls, garages, etc.)
  • Installation or stacking of items that are not easy to move (over 5 tons)

In addition, in application, statement of position of each association is necessary.

Things to keep in mind

Regarding the "lot number of the act" on the Article 76 permission application form, please check with each association office when obtaining the "temporary substitute lot certificate" or "reservation land certificate" issued by the association.
When notation of "lot number of act" is not unified, we may affect procedure of building confirmation.

From April 1, 2020, the submitter will be required to present identification documents when applying and receiving the application. If you are a corporation, you will be required to present a document that shows your affiliation (employee ID, business card, etc.) in addition to your identification documents.
In addition, as a result of this, it is no longer necessary to stamp the applicant and agent columns on the Article 76 permission application form.

Buildings requiring building certification

About books from 6 to 12, we assume diversion of building certification application book basically.
Documents 2, 3, 5 to 12 should be attached to each association's opinion inquiry , and documents 1, 3 to 12 should be attached to the Article 76 permission application .

  3. Power of Attorney (those that clearly state the procedures for Article 76 of the Land Readjustment Law)
  4. Enforcer's Opinion
  5. A copy of the provisional replacement certificate or the reservation certificate, or both
  6. Building confirmation application form (pages 2 to 5)
  7. Guide map
  8. Layout plan [1/500 scale or more]
  9. Each floor plan [1/200 scale or more]
  10. Elevation view (2 or more) [1/200 scale or more]
  11. Cross-sectional view (2 pages or more) [1/200 scale or more]
  12. Materials showing grounds for site and building area

Structures requiring building approval

Documents 2, 3, 5 to 9 should be attached to each association's opinion inquiry , and documents 1, 3 to 9 should be attached to the Article 76 permission application .

Note: Documents that indicate what is being relocated or newly established, such as pipe diameter, pipe material, overburden, position, etc. The same applies to structures and retaining walls.

Subject acts that do not require permission

Among the construction activities that do not require building certification, procedures will be omitted for the following activities that are deemed to pose no risk of impeding the execution of the project. In addition, the act of the project concerned and the relocation of the structure at the request of the executor are not subject to this procedure.
In addition, actions other than those listed below will be judged based on the content, so please consult with the executor (each union) in advance.

  1. Repairs and remodeling of buildings and designated structures that do not require building certification
  2. Installation of lead-in lines for gas, electricity, telephone, water supply, and sewerage associated with construction work
  3. Actions that have been discussed with the future manager of the road as stipulated in the business plan for structures within the road
  4. When carrying out procedures in lieu of Article 76 of the Land Readjustment Act, such as concluding an enforcement agreement, for acts of city planning projects other than the relevant project (limited to cases that do not involve building certification)
