There are two systems to legally support individuals who lack sufficient judgment ability due to dementia, intellectual disabilities, mental disorders, etc., by selecting a supporter to protect their rights: the statutory guardianship system and the voluntary guardianship system.

  • What is the Legal Guardianship System is used when a person's decision-making ability is insufficient, and it is divided into three categories: "Assistance," "Support," and "Guardianship" according to the degree of decision-making ability. It is a system in which adult guardians, supporters, and assistants selected by the family court support the individual by utilizing their authority to act, consent, and revoke, while considering the individual's best interests.
  • What is the Optional Guardianship System? It is a system where, while the individual still has sufficient decision-making ability, a guardian is chosen in advance to prepare for a future decline in decision-making capacity, and a contract is established in the form of a notarized document granting the guardian authority over matters such as medical care and property management.
